Today, while on my run, I was attacked by my neighbor's new dog. It apparently didn't like me running past their house and broke free from its chain. I now have stitches and was just told that I'm probably being taken to court for the emotional distress I caused her and the dog. FML

Take pictures of your injury now, in case this goes to court after you've healed. As long as you have a good lawyer, you shouldn't lose. Still, FYL for the hassle and lawyer fees :

You do realize that not only can you countersue for your own emotional distress, in addition to medical costs, court fes, etc., but you can report the dog as being vicious and dangerous to the police and have the dog put down before anything goes to court. Take pictures of your injuries and contact the local authorities.

counter sue for pain, suffering, medical bills, lost work hours, and mental/emotional distress . she will drop the suit and settle out of court.

As an attorney, I agree w everyone on here telling you to countersue, or simply sue her yourself since odds are 99% likely that any attorney she consults will tell her she has no case against you and is completely liable for your injuries.

Bring medical records and try to get a witness statement. Then laugh all the way to the bank when the bitch has to pay for your medical bills and the mutt is euthanized for aggression. :D

Heh, she has no possible hope of winning that lawsuit. But you definitely could sue her, and probably should!

this is ridiculous. what emotional distress have you caused this woman or her dog? im sure she's probably swimming in debt and just needs alot of money - and it's typical that people these days depend on sueing for their income...
