Smooth criminal

Today, my neighbor's son siphoned the fuel out of my lawn mower and put it in his car. What he didn't realize is that the fuel mixture I use in my lawn mower would ruin his car engine. His dad says it's my fault and actually insists I should pay his pissant son's repair bill. FML

You can take legal action against anyone for pretty much anything now a days I could sue someone for looking at me wrong. As long as a lawyer will take the case then you can.

That doesn't mean the case will work in your favour, however. But in this case, stealing gas IS a crime.

I'm not sure how much it'd do. I guess if either are on bail it may get it revoked though. He should just tell the Dad that the cost of the new engine is a moron tax.

I believe he meant if they are out on bail, because if you break a law while out on bail, it is revoked..

Take him to court if he presses the issue. You have to have "clean hands," meaning you can't be awarded for damages caused while committing a crime.

There is an exception if there is considered to be a valid duty of care which the defendant breached, which is why a burglar who got trapped in someone's garage for three days subsisting on dog food was able to successfully sue the homeowner's insurance: this standard prevents booby traps and blatantly unsafe conditions from being protected even if the claimant was engaged in criminal conduct. Of course, none of that applies to this case in any way that I can tell.

He won't make any money taking this to small claims. Even if his neighbor has any which I doubt. Gotta sue the people with money. If you don't, even when you win you lose.

No, because they're just trying to get money. His son's car doesn't need to get repaired, because it isn't broken. Mix gas dose not do anything to a regular gas engine. It's no different than an older car burning oil.
