How were you positioned for this person to think you were dead? They must have been far away and didn't bother to investigate. If they did they would have at least been within earshot for you to hear them call the police

Yes, accidents happen, but this is not an accident. It is easy to check to see if a body is dead or breathing/moving/reading, etc.
