Depending on the disability protection laws in the country you live in, if you can prove that the absences were due to a legitimate disability, and that the employer failed to make reasonable accommodations you have a pretty cut-and-dry lawsuit on your hands there. Talk to a lawyer.
If they didn't request a reasonable accommodation, they are entirely SOL.
My last job did the same and they hired me knowing i recently had back surgery

did your job know about your disability? if they did, you may have a good case against them depending on where you live.
