OP, divorces are definitely a struggle; there's so much involved, especially if you have kids together. I wish you the best in all of this. It's definitely not easy, most of the right choices aren't. That said, assuming she was 16 (or 17) when they slept together, the only possible charge in Oregon would be: "Sexual Abuse 3 (Class A Misdemeanor)". (If she was 14 or 15, it would have been a Class C Felony: "Rape 3 / Sodomy 3") According to OP, the girl in question neither looks like nor acts like a child.
