Today, I picked up my car from the repair shop, drove two miles, and ran out of gas. I then walked to get gas, put a gallon of gas in the car, and tried to start it. The battery was too weak to start the car, and died on the spot. FML

Today, after my car died a mile from my house, I huffed, puffed and pushed it back to my house off the street, so I wouldn't get a ticket overnight. After getting it towed to the shop in the morning, I got a call telling me they put gas in it for me and it starts up fine now. FML

Today, I pulled into a parking lot, for the car to simply shut off because I ran out of gas. Then I couldn't get the key out of the ignition, so I called my dad, who walked all the way to where I was, only to find out that the car was still in drive. FML

Today, my friend's van ran out of gas on an expressway off-ramp. After pushing it to the shoulder, we walked to a gas station and got a can of gas. We got back to the van to find that the battery had died from leaving on the lights and hazards to avoid an accident. FML

Today, I went to Auto Zone because my car was having trouble starting, and I thought it was the battery. The guy checked it with their reader, and confirmed it was dying. Right after he put the battery in, my starter died. I had to get my car towed to the shop. FML

Today, I got into my car and it wouldn't start. I noticed I had left the lights on and assumed the battery was dead. Then, I couldn't get my key out of the ignition. So, I called AAA only to have the guy put my car in park and start the engine. FML

Today, I went to drive my mom's car for a change. It wouldn't start, so I open the hood. Someone had stolen the battery. I go to start my own car so I can drive to the police station to report the theft, and discover someone siphoned off my gas. FML

What exactly would he sue for? It isn't the responsibility of the shop to make sure his gas is at an adequate level. As for the battery, that's just bad timing.

Why would OP sue? These things run out over time. It is neither OP or the mechanic's fault that the battery chose that exact time to die. 28 - I love that song. It serves as a reminder of some the most ridiculous things people will sue for.

If all those problems should have been fixed or were caused by the repair shop, looks like you'll be getting your car fixed again for free. Also, while you're at it let them tow your car as well as provide some transportation for you if you are going to be without a car for a length of time.
