Today, my boss fired me for "fooling around" on my phone. I was looking for supplies for a surprise party we are throwing him for his birthday, and I didn't want to do it on my work computer because he has access to our history. Also, this happened during my lunch break. FML

Today, my boss fired me by locking me out of my workplace after I went out to throw out the trash. FML
Today, my boss threatened to fire me if I didn't stop looking at my phone while working. I work in the back room, and there is no clock in there. I look at my phone to check the time. That way I know how long I have left in that hellhole. FML
Today, my boss left early, so I decided to take an extended break and run home. I found my wife in bed with my boss. I got fired for leaving work. FML
Today, my boss called me to say that I'm fired because I was "deliberately ignoring" the messages from a head of another department who wanted to contact me regarding some "urgent" (not really) project. I was on "Do not disturb" because it's my vacation, and this SOB is not even my boss anyway. FML
Today, my girlfriend came to my workplace to tell me she was breaking up with me. My boss, who was passing by, fired me for "chatting with friends" during work hours. FML
Today, my boss went out for a few hours. My coworkers saw this as an opportunity to take a 2 hour lunch without getting caught. I stayed at the office to answer the phone, while streaming videos which is a big no no. My boss came back early and caught me, they're all still taking lunch. FML
Today, I was fired. Why? Because I called in sick on my daughter's birthday, even though you cannot "abandon work for personal affairs". My boss's favorite employee got to skip work on his wife's birthday two weeks ago. He still works here. FML
Today, my boss bitched me out for doing some random web browsing while waiting for some documents I needed to arrive, then went back to his desk and went on Facebook, thinking I couldn't see. FML
Today, at work, I stepped out for a few minutes to use the bathroom. Shortly after returning, I found out the hard way that one of my coworkers had used my computer to send a profanity-filled email to our boss, calling him an asshole and telling him to go fuck himself. I'm now jobless. FML
Today, I gave my boss a gift card as a late birthday present, since I wasn't in the office on his actual birthday. He accused me of trying to bribe my way to a promotion, and suspended me on the spot. FML

Write him a nice (not cynical, non-threatening, not nasty) letter explaining everything (lunchtime, his birthday party, etc.) because you will probably need this man for a reference and you don't want to totally alienate him when new employers call for references. If he is a decent human being, he will feel like a complete shit and hire you back or at least offer to give you a decent reference. (Get a friend to check up on the reference in a week if he is willing to give you one.) If not, at least the company will have a record of "your side of the story." (assuming he forwards your letter to H.R. If he still doesn't hire you back, than he's an asshole and you deserve a better boss anyway. Unfortunately, in the US employment is "at will" so your boss can fire you for any stupid reason. At least it's summer... Try and have a few good days off before hitting the unemployment office. I would contact the person that's over your ex boss and report him. He can't fire you for talking on your phone while you're on your break.

Like many have said before me, you shouldn't simply get fired by being on the phone during your lunch break. There is either more to this story, or your boss is simply an a-hole. If I were you, I would drop the surprise party, contact human resources or the person above your ex-boss and explain the whole situation, and finally let your ex-boss know that your "fooling around" was preparing him a surprise party DURING your break, and that he can forget about it.

I'm a boss - talk to yours , you will probably find out that he is really understanding once you explain the situation . Or you can go the other route and serve him with wrongful dismissal paperwork at his party and that should make him feel like a total tool.
