Today, I work at McDonalds. I burned my hand while cleaning their grill and have a 2nd/3rd degree burn from my pinky to my wrist. When told about this, my manager told me that there was "nothing that they could do for me and to tough it out". However I was given a free McFlurry. FML

PLEASE write down in detail what happened and everything he said to you . The sooner the better; the fresher it is in your mind, the more you will remember. Save all written materials, receipts for medical care and medication, including over-the-counter drugs. Take pictures of your injury, if you haven't already and make sure it is dated somehow. Take another picture every few days and date it. Write down all the effects of your injury, particularly things that you can't do because of it. If you do call HR, write down everything you told them and everything they told you. They may advise you to file a Worker's Compensation claim. It would be very good to talk to a lawyer before do this or sign any type of agreement with the company.

Get better quickly and as soon as you are well, find a lawyer. If you're underage, have your parents seek out an attorney for you. You might very well qualify for your county's Legal Aid which will be free or absolutely no more than you can afford.

But don't let this pass. It's not right, and it's my strong belief that you are entitled to damages. If that manager gets away with treating you like this, he will do it to more employees. This is what civil law is for, IMO. (I work in the legal field, BTW.)

#55 - On 02/08/2010 at 2:41am by callargh

(+1)

Regardless of who's at fault (presumably the OP's clumsiness, or the employer's failure to prevent), the employer is required in most countries (including where I come from - Australia) to have a decent First Aid station, even if it's just a chair and a First Aid Kit, which is capable of treating things like burns.
The employer/manager at this particular chain is obviously a jerk, and presumably is either an arrogant boss, or someone who doesn't give a crap if he loses half his employees because he reckons he's so good he could replace them the next day (which is partially true, and that's why Macca's is scary).

#104 - On 02/10/2010 at 10:22am by jaded_gal

(0)

Yeah right, fake much? It's called an incident report, which forces them to send you to a doctor.

#6 - On 02/07/2010 at 7:48pm by um_meh

(0)

I wouldn't say it's fake but the op did probably over exaggerate.
at my store we are only required to send them to the doctors if it's a serious injury such as a broken bone or deep cuts, if it's a mild burn (which I assume this was and was overexaggerated) then the store will generally have burn aid and bandaging in stock. the incident reports we have do suggest that you give the crew member a free meal though.

#11 - On 02/07/2010 at 8:43pm by rjdr

(+1)

Also, anyone who assumes that all managers are actually legitimate enough to write the incident report has way too much faith in humanity. Some places I've worked give bonuses to managers who keep incident counts down, and some managers will do anything for that bonus, even at the detriment of their employees.

#51 - On 02/08/2010 at 2:11am by OkageStarr

(0)

And they're especially prone to trying to buck the system when they have a minor who isn't apt to be aware of the procedure they are supposed to be following. This incident, even if it is a simple burn, should have been documented. After all, it doesn't take much of an injury to lead to an infection that worsens things dramatically.

#73 - On 02/08/2010 at 12:25pm by olivejuice001

there is actually not much they could have done if you burned yourself cleaning/steaming the grills or whatnot. You should have been wearing your safety gear, that's what it's there for. I burned myself a similar way at McDonald's as well, and in orientation everyone is required to sign a safety agreement before your first shift. In that document it states that any injuries received while not wearing the proper equipment do the job does not fall on to the restaurant. Yea your manager should have reminded you to put your stuff on, but it's ultimately your fault.

#20 - On 02/07/2010 at 9:44pm by emily234

(0)

this is not true because companies have rules regarding worker injuries. they need to be documented and there are protocols to follow. a real manager saying that would be fired for such conduct. do research before posting things like this

#21 - On 02/07/2010 at 9:48pm by novakman

(+1)

Listen to everyone! You need to go to the doctor/emergency room and file a workman's comp form. They are absolutely required to pay for all medical treatment and pay you for any time you are off of work. I can't believe anyone could be a manager at a corporate business and not realize the company's liability. Don't try to go after that manager specifically, just record their reaction and they will probably be dealt with. I have worked in restaurants for 15 years, from big corporate ones to small family owned, and they ALL know they are responsible for ANY injuries of employees, even if you did something stupid to cause it. Which I'm not saying you did. That guy is a moron and so completely wrong its laughable. While like #20 said, you may have had to sign something, and maybe you weren't wearing the required equipment, all that means is you can't sue them or accuse them of unsafe working conditions. Regardless they still need to pay your medical bills and give you workmans comp for time off. An injury on their premises is still an injury.

this ^
you had 1st/2nd degree
I was a manager at mcdonalds and I would have treated your burns with appropriate first aid, then sent you to the doctor to get your burns dressed. Then filled out the employer part of the WCB claim, and the dr. would have as well. then you get to take whatever time off dr. said or performed modified duties so there was no lost time. good luck to you

#30 - On 02/07/2010 at 10:56pm by pansy2me

(0)

I know how you feel! I also work at McDonald's. I have a scar about 3 inches long on my forearm, from the Filet O' Fish bun steamer and many on my hands from the grills. Your manager should have filled out an incident report, and you should go to the hospital. If there's serious damage then your general manager has to do a follow up. If that happened at my store, I would have been sent home.. or to the hospital. Definitely don't take this lightly!
Hopefully you heal quickly, although my burn took a long time.

#48 - On 02/08/2010 at 1:37am by MADDOGCA

Yeah, part time workers don't get anything. I work at Subway and we've had two girls get hurt pretty bad. One sliced her finger open with a knife and the other got a pan of bread dropped on her arm (350 degrees F). The one with the sliced finger got to leave for stitches but had to come straight back to work, while the burned girl got laughed at. It was a fairly serious burn and left a huge scar. We get cut and burned all the time and our manager never does anything to help.

Ok, as a fellow McDonalds employee. I have come to the conclusion that both you and your manager are complete fools.
The manager SHOULD have filled an incident report in, and sent you home/hospital.
YOU should have worn the proper Grill Cleaning (Heat proof) Gloves, to prevent yourself from getting burnt at all, I mean seriously PPE (Personal Protective Equipment) is there for a reason.
So don't have a whinge if you don't know how to follow McDonald's safety procedures.

I am a manager of McDonald's... they can't tell you that there is nothing they can do... there is plenty they can do...Your manager that was on, obviously didnt want to do the paper work, or cover the rest of your shift... You need to go and see your restaurant manager and tell them what happened.

#99 - On 02/09/2010 at 6:10pm by ollie12

(0)

You don't have to sue buddy. You store / McCdonald's has a worker's compensation (WC) coverage / policy which will cover all work related injuries. WC is on a no fault basis in MI and most states, i.e. there has to be no fault from any party, the policy simply pays out if there is any injury / loss. Give any related medical bills to your manager and ask him file appropriate WC claim or you will call OSHA or McCdonald's corporate. You can however sue them for improper treatment & OSHA violations, and probably will get some money out of it.

Have to agree with many other posters. Your manager's either an idiot or is trying to bank on the fact that you probably don't know your rights as an employee. He may even try to insist completely that you don't have any rights when you go back and insist that you do. Hold your ground.

If this guy is pulling crap like this with you, it's likely he's pulled it with others and will continue to do so. Put a stop to that very quickly by handling it through the proper channels. Demand incident reports and proper workers' comp paperwork. If he won't give them, call HIS boss. And up the chain.

And when did they start giving protective gloves? I worked there in high school and it was bare hands all the way (also, uphill, barefoot, in the snow, both ways).

What you get for living in a country with privatized health care.

Next time move to a country with actual police/fire/health care/education services.

First-degree burns are usually limited to redness (erythema), a white plaque and minor pain at the site of injury. These burns involve only the epidermis. Most sunburns can be included as first-degree burns.

Second-degree burns manifest as erythema with superficial blistering of the skin, and can involve more or less pain depending on the level of nerve involvement. Second-degree burns involve the superficial (papillary) dermis and may also involve the deep (reticular) dermis layer.

Third-degree burns occur when the epidermis is lost with damage to the subcutaneous tissue. Burn victims will exhibit charring and extreme damage of the epidermis, and sometimes hard eschar will be present. Third-degree burns result in scarring and victims will also exhibit the loss of hair shafts and keratin. These burns may require grafting.

YDI for exaggerating.
