Today, after work, I parked in the parking lot I go to every day to let heavy traffic go by. As I was about to leave, two cops suddenly yanked me out of the car and arrested me for "stocking," as they spelled it on the report. Some paranoid girl thought I was parking there every day to watch her. FML

Suing in civil court is not always for money. You can sue for restraining orders against the psycho, formal apologies and suspension for the police and clearance of your criminal record. The only money that gets sued for is the lawyer's fee.

As hilarious as the misspelling is on the police report, you're going to have to take the charge seriously. Its unfortunate, but grab a lawyer so they don't prosecute you. A misspelling on the report will not lead to the charges being thrown out.
And suing them for false arrest? Ha. Given our country's new habit of ignoring habeas corpus, I would surmise that your odds of a successful false arrest lawsuit is somewhere around those of the proverbial snowball. People have a hard enough time suing a city when they've been blindsided by a city bus - and that's a situation with obvious physical damages to the vehicle and passengers. Good luck.

It was a parking lot for a grocery store. My car is a beige '82 300D Mercedes. I don't think it looks that suspicious. In a parking lot you can turn the car off.

Dude, your life could be ruined by this. You are truly screwed. Unfortunately the police are REQUIRED to arrest if such an accusation is made (unless it is blatantly obvious that it could not be true).
Chances are, the police had been called DAYS BEFORE and began watching the parking area over a long time. Sure enough...the "stalker" appeared on several days. Finally, they made the arrest based on the "evidence" of the law enforcement's observations and the woman's allegations. Juries WILL believe the cop's observations (not necessarily the conclusions).
The prosecutor's official will look at the CIRCUMSTANTIAL case and determine whether or not there is a chance to win a conviction.
And if you ever have to get a background investigation done (like for MILLIONS of jobs) you will likely be required to report ANY arrests. Unfortunately people will ASSUME the arrest = CRIMINAL. Even if the charges are dropped, they will ALWAYS suspect/think "He did it, otherwise why would they have arrested him? The prosecutor just wasn't good enough or there wasn't enough evidence."

This situation is a result of the post 9-11 hysteria, zero tolerance policies, and America's love affair with police and putting people in jail.

I was told they spent 3 weeks watching me before they decided to randomly arrest me one day. This really did screw my life up. I did get a lawyer though, but it didn't help. No offense to anyone living in the south, but the local government will believe anything the cops tell them. I was "let off" with 1 year probation as long as I would go see a psychologist once a week, that I have to pay for. I also am not allowed to park in the parking lot that I was arrested in. It's a parking lot for a grocery store.

First of all, I would like to point out that it really sucks that this happened to the OP. But, when it comes to all the cop hate, yes they may have overreacted, but had it actually been a real stalker everyone would be pissed if they had known something,had done nothing about it, and something terrible happened to the girl. As long as the OP didn't do anything wrong it should all just go away. And I would advise not suing anyone because it could lead to the cops being my cautious next time when there is an actual danger.

My friend, Guy, used to be an EMT in GA, he shows up on the scene to find a guy who had been shot through the windshield of the car, and he had a loaded gun in the car. The cops filed the report as suicide. The window was up, gun was still fully loaded, and apparently the guy reached around the front of his car shot himself in the head, then proceeded to get rid of the evidence to make it look like a murder, shut the door, and then died. Dumbass cops... There's probably a few good ones though..

I feel you, OP. My husband was arrested two years ago for something similar. He stopped at a convenience store on the way home one day and had his cell phone out because he was using it to talk to me. He walked past a young lady in one of the aisles and she called the cops and told them that my husband tried to use his cell phone to take a picture up her skirt (camera function doesn't work during a phone call, however). He spent the night in jail and although the case never went to trial because there wasn't enough evidence, he lost his whole career (high school teacher in a small town) over it.
