Today, after my first day at work at a local daycare, I found out that I'm not entitled to breaks because I'm the only worker there who doesn't smoke. My boss asked me, ''What do you need a break for?'' FML

Report him. You're just as entitled to a break as everyone else.

That's just sad...

For your boss - because it's the law. If you are denied breaks you can sue.

That's discrimination OCESHA OR however it's spelled

by law you are entitled to a break every six hours of work you can have 20 minutes.

What a jerk!!!

buy fake cigarettes and say you smoke too...

Well if you work at a daycare your co-workers shouldn't be smoking in the first place, unless they're going off property and doing it.

Why would they have to go off property? They could very easily go smoke behind the building where no kids should be.

"If you smoke you get more breaks." -My old boss

Um you can get them into trouble. It's law to give breaks. And what a dumbass for her saying what she said.

Not allowing someone a break is a violation of labor laws.
