Today, I came home a few days early from a 3-month business trip. As I opened my apartment door, hoping to surprise my girlfriend, the man she’s apparently been cheating on me with promptly punched me in the face. He thought I was a burglar. FML

While I'm not for suing the pants off of people at every turn, you could take him to court for assault, assuming that your girlfriend's (hopefully now ex-girlfriend) name isn't on the lease. There's the possibility that he didn't know she was cheating, so I'd find that out first, but damn, that's a low blow.

I think you can't sue him for being there since you probably gave the keys to the girl and he was a guest of hers but I believe that the assault can't be considered self-defence since you didn't force your way in.
I sincerely hope you threw all her stuff away in the street and changed the locks..

You could sue the dude for breaking and entering/trespassing/assault. Because even if your girlfriend had permission to be there he didn't. And unless you two share the apartment, she didn't have rights to decide who gets to come in and out of YOUR house. Plus he hit you on your property. So even if you don't get him on the trespassing charge, you'll for sure win the assault case.
This is a great opportunity for an amazing Assault Court Case.

So either you got rid of an ugly girlfriend or you are no longer delusional. Either way, you win.

If she loved him she wouldn't have done anything! So I wouldn't call the OP "delusional"!!! I waited for my boyfriend for 12 months when he was deployed to Afghanistan and no I did not cheat...now we're married and going through 15 months of him being in Iraq...and I still didn't cheat.
If she never gave him a reason not to trust he before this...then he was definitely not being "delusional" because he trusted her not to do anything while he was gone!

@66: Dude that's not right to assume that any member of the military who goes on deployment cheats. I know several soldiers and other military members who are faithful when they go overseas. Seriously, did you get stabbed in the back by one of the very few members of the armed forces who did cheat?

A few thoughts, and some of them will most likely be repeats of others as I didn't go through every single post:
#1. It's true that while you cannot press charges for trespassing assuming that you and your girlfriend share this apartment, you can still press charges for assault. And you will win. Judges will see the context of the event, and you probably won't even have to miss an entire day of work.
#2. 3 month business trip? Jebus. Where did they send you? I mean I get a 2-week one, and my girlfriend flips out and wants to have crazy internet webcam sex all the time.
#3. If you are going to be doing these 3 month business trips that often, maybe look to be single for a while. It's not so bad.
Either way, in the end, be done with the situation. If it's your apartment, tell her to get out. If the lease is in both your names, explain to the landlord what happened. If you have to pay to get out, do it, or else you will be reminded of it every day. Good luck.

Don't sue the man, if he thought you were a burglar then your girlfriend must have told him that she wasn't with somebody and that it was her house. Ya it was a dick move that he punched you, but he may be as innocent as you.
