Today, I got called out of class to talk to some cops. Turns out my car was involved in a hit and run accident, while I was in school and there was no possible way it could have been me. But since they have no one else, it's my fault. FML

agreed with #5. No real, trained cop charges you with a hit and run event if you were in school and people seen you there. You may be a 'suspect', but that doesn't mean you are truely at fault.

For example in Hungary this can be real. It is callect objective responsibility (or something like that, I'm not a lawyer to translate the name properly).

If somebody uses your car and cause some accident, trouble, or break some rules, the cops will come to you. If you hadn't reported the theft of the car earlier, you get the penalt instead of the sinner. You can ask for fairness, but you can be unlucky.. You know, life is just a big FML.

It didn't use to be this some years ago, you could say any time that it wasn't you, a relative of you used the car, and according to the hungarian law you can't be forced to depose against a relative, and the cases were dropped. So the law had to be changeg...

Actually, this exact same thing happened to me, it was an investigation that lasted for months because I had no concrete proof that I was at school. Eventually the investigator stated that there wasn't enough evidence and the case was let go, but yes, it can happen. :\

@63, yes you can CHARGE them with a crime if they committed it or not, they can charge you with anything, they are just not suppose to be able to convict you if you are innocent....

Do people really believe that the US law system is perfectly flawless? Hell, even the Supreme Court is a bastion of partisanship!

As to the OP, it's not your fault yet. You aren't guilty until proven to be so in a court of law. Anyway, this should be a really case to fight against.

Of course it's legal to make an accusation, the trick is proving it. If the OP was really in class, proving that fact shouldn't be difficult...

well it's clear that his car wa stolen while hhe wa in class so what I'm saying is how could they charge him with a hit and run if he ha a solid alibi and witnesses(classmates an teachers) plus the fact that if he ha been involved how did he get back to school w/o his car and where was it? that's what I'm saying it jus seems like the cops were falsely charging him(not sure if that's the right way to phrase that)

You guys dont even realize, the cops suspect that the OP loaned her car to someone and she wont admit who it is. So they charge her with the crime hoping that she would rat out her friend. Thats why shes charged......

unfortunately they can charge the owner of the car. He will have to go to court to prove he was in class and find out who was drving it when the accident happened so the charges can be applied appropriately. But because his car was involved, his insurance rates will increase.

I'm sorry. :-( A similar thing happened to me once, except that I got blamed for sending cyberhate messages--which were sent while I was in ballet, by an email address that had my name misspelled. Nobody believed me except my mom and the two friends I told. So I completely empathize, OP.

In regards to the FML, I don't much believe it. You either weren't in class and distinctly lack an alibi or you were and they have to move on. The police get a lot of spiffy liberties for their jobs, but throwing whomever they want under without clear evidence otherwise isn't one of them.

The fact that the police made an accusation does NOT mean it was your fault. It just means you will have to go to Court and prove you have an alibi (or, since you live in the US, I think it's possible for you to prove the DA that you have an alibi and he/she should drop the charges).

That would be a personal opinion that I'm strongly disagreeing with. Her story was completely related to the original FML and therefor was relevant for the comment. She may have tried said FML before and gotten nowhere like so many do or she doesn't feel the need to post an FML for something that wasn't so recent since all FMLs need to start with "today." Either way, your outburst at her obviously shows that she's getting to you and you need to step back from the computer and take a breather because nobody online should be upsetting you that much that you stalk them from FML to FML. It's doubtful that I'll even remember your username after this or that anyone else will, either. Is that why you're so upset? She's a big name on here and you most likely never will be. they don't usually jail you on suspicion of hit and run, unless you pulled a lizzie grubman and mowed down 15 ppl at a nightclub in the hamptons... esp if nobody was hurt. since the OP is a minor - i think- the cops don't think they know their rights. i have had many run-ins with the police in my day, and they think that telling u that ur goin to jail if you don't tell them what they want to hear is gonna scare you and make u spill the beans. just say the magic words 'I WANT AN ATTORNEY' even if you did nothing. it's funny how it pisses them off cause they have to quit talking to you at that point

Yeah, if they hauled you out of class to just talk, thats one thing. However, if they charged you, then they would need definitive proof that it was you, either some sort of video surveillance, eyewitness accounts, etc. Based upon what you stated, you should not be charged for something of that. The alibi of being in class would be sufficient to clear you of charges. Now, if it was still your car involved, then yes, further action may be needed, such as if you lent it to a friend for while you were in class, or if it was stolen. Could even be a case of a falsely identified vehicle. Or, in a different situation, they could be following up on an accident you may have been involved with at some time you werent in class...

I don't know why people are saying this is fake; it's most definitely believable. My junior (or senior; I can't remember really) year of high school there was some douchebag breaking into a bunch of peoples' cars in the parking lots and one of my friends actually had her car stolen. She reported it stolen and a week went by with no sign of it. One of her friends was driving her somewhere and they spotted her car - a few freaking blocks from the police station. She had her keys so she got in and was driving to the police station to let them know she found her car when a cop pulled her over and arrested her for driving a stolen car. It took a good half hour of screaming and crying to get the idiot cop to realize that it was, in fact, her car.

What if their car wasn't the one involved at all?

That happened to my brother. His car was in our open garage while he was SLEEPING. The cops came to our door and accused him of being in a hit and run and that the other person had followed him to our house and saw him go inside 10 mins earlier. My brother and everyone in our house explained that his car had been in the garage for the last 3 hours and he had been sleeping for the last 2. But, he had a teeny tiny scratch on his bumper while the whole side of the other car was smashed in. So what's the logical thing for the cops to do? Tell my brother they're going to take him to jail if he doesn't admit guilt and give him a ticket for leaving the scene of an accident (a felony in our state) apparently.
