Wow, I didn't realize it was a crime to not avoid crashes. I mean, avoiding a crash would be common sense, but I didn't know not avoiding one was illegal.

Under no circumstances will you be found in the wrong, as it is ALWAYS the person behinds fault, unless you were reversing.
Then, contest the ticket. If nothing happens, ring the local current affairs, they'll have a field day with it.

Honestly, contest it. If you're feeling really spiteful, make sure he gets fired. What he did is not legal in any way. You're in the US. It was his fault completely, unless you suddenly slammed on the brakes and your state isn't like mine, which states that if you get hit from behind and no one can prove that you were in reverse, it's the other person's fault. Even if your state doesn't have that law, it would be at least partially his fault. He was tailgating you while talking on a cellphone.

When I was about 8 years old, I was in the car with my dad when he was sideswiped by a state trooper who pulled out of McDonald's parking lot without pausing or looking where he was going. The cop tried to pressure my dad and insist it was his fault, and attempted to write him up. He finally backed down when eyewitnesses defended my dad and offered to testify for him if my dad appealed the ticket. The cop was a total pig about it. Didn't seem to care that me and my 11 year old brother had to go to the emergency room to get checked out either. Only cared about saving his own ass.

If you're in a position to avoid a crash and you don't, then yes, you can be held responsible to a certain degree. (Depending upon what position you're in.)
But in this case she was in no position to avoid the crash... the person behind is always at fault (unless of course the person in front is reversing I suppose).
Well, you can get a ticket for driving too slow (it's a reckless driving thing).
That, however, is bullshit. It's always the other person's fault if they friggin' rear-end you.

Sorry, OP. When someone hit my car, the police officer tried to blame me despite the evidence and eye witnesses. Then he tried to cite me for not using my seatbelt because it was discovered in the upright position when he looked into my car... after I'd already gotten out, with a bruise on my chest from its strap. A cop did something similar to my mom. He tailgated her when she was in her so he could get her to speed. What he didn't know is that she was in an undercover police car. She went 5 over the limit to get behind him so she could pull him over for tailgating and reckless driving. Before she got behing him he turned on his blue lights... All state troopers have dashboard cameras. Take him to court to contest the ticket and use the camera as evidence. They can also match the time on the video to his cell phone records and see that he was on the phone. You'll get out of the ticket and he'll get in trouble.

In Erin Brockovich, she lost a civil case for being a woman driver. She was also fired briefly because people assumed she was incompetent, mostly because of the way she dressed. Stereotypes work against people all the time, unfortunately.
I had a similar situation like this one. A cop crashed into me on my motorcycle, and tried to give me a ticket to make it seem like it was my fault. Instead of just taking the ticket and walking away, I made a scene, and eventally got his supervisor to come to come down. The ticket was torn up by the supervisor. Now a days, cops think they can do whatever they want without consequences. Just go to court, and sue his ass!!!!!!!

Im not sure about where you live but I know in some states, and maybe even most if not all, if you get hit from behind the person that hits you automatically is at fault. In the state of Maryland, it's automatically your fault if you rear-end someone. Therefore, the cop is definitely at fault (and it won't be hard for you to prove as you're the one who got rear-ended) and you can battle it (the ticket and him blaming you).
Two words:
NEWSPAPER and SUBPOENA (as in phone records).
He'll lose his job over something like that. It's unethical to the hilt!

thats why out here in AUS, a cop that is involved in a accident cant issue a ticket or investigate the accident.
it has to be done by a officer from a different patrol area..
Take him to court over it. and DONT forget to have them pay for your lost day from work :)

Stuff like this happens all the time. A few weeks back, a woman in Florida was arrested after a cop rear ended her, fabricated a story, and took her in for DUI. She was released after the cop's in-car camera caught he and his buddies making all the stuff for the police report up. Now he's getting fired.

Two words: sovereign immunity. You may be able to show he was acting outside the line and scope of his duty as a trooper, but at the very least it's going to be a tougher case to make than against a non-pig.

Legally speaking, you can be held accountable if a police officer slams into you. Its one of those little nifty things they hide into laws nobody has heard about. The same thing happened to someone I know once, the Judge threw out the ticket and points but noted that the police officer couldn't be held accountable due to the same law. It's never, legally, an officer's fault if he's uniformed, in his patrol car, and on duty.
It isn't fair, it's just there so that, say, there's a high speed chase and a few cars get whacked in the process, the police department doesn't have to pay for them. The ticket you got is bullshit though, as that's a bullshit charge, and will get thrown out in court. Also, if you have decent insurance and your car isn't totaled you'll probably have the repairs covered by the insurance company. If you have shitty coverage, sucks for you, drive a sturdier car :P

get a lawyer and take him to court...if he was following proper driving protocol he shouldve been two car lengths behind you if it was clear weather or double that if the roads or wet or other bad conditions. regardless if he hit you from behind it's not your fault. take the cop to court...what he did is not legal.

He's a cop. Taking him to court is probably a bad idea. Not to mention, he probably would have 'no faulted' the accident if you weren't being an asshole to him. I am assuming you were being an asshole.
if you really want to get back at him, don't take him to court. Having something like that going public will do more harm then good no matter the outcome. What you do is notify his supervisor or chief. They'll determine whether or not who has been wronged. Chief's aren't the type of people who let their officers slide with something that stupid, the only thing is it's a judgement call. If it happens you were being a dick, the chief will politely tell you to fuck off

First off, fight it. Second off, its not illegal for cops/paramedics/etc. to use cell phones, they are excluded from those laws. Third, did anybody notice this chicks username is rammed behind?
you should have called 911 before letting him go. tell them that "someone" rear ended you and you needed an officer there. then the cop would have been the laughingstock of the season and would have probably gotten fired.
Don't worry, that ticket won't stick, in court the judge will be like "WTF!?! You can't give tickets for that!" and the cop will possibley get into some abuse of power problems and forces to take a remedial driving course. DE

unfortunately, it is your fault in the eyes of the law. anytime his car is hit, it is the other cars fault. fortunately you can appeal the ticket.
Unfortunately, as a fellow Maryland resident I totally believe this doofus incident could happen. However, also as a Maryland resident I know police officers often don't show up to present their side of the ticket. You should definitely show up to traffic court and present your side of the case. Even if you have to pay, at least the judge, and a bunch of other defendants and officers, get to hear that that cop was doing what we complain about civilians doing all the time, namely talking on the phone while driving.
You should also write to the Dr. Gridlock column in the Washington Post and the Intrepid Commuter column in the Baltimore Sun to make this known to the public.
