Today, I found out I have a restraining order against me from my ex boyfriend. Apparently, I drive by his house too much and it is considered stalking. He forgot that I live 2 houses down, and MUST drive by his house to get home. FML

I have had friends get restraining orders in situations similar. So it IS possible. All judges are different.they are not my GOOD friends due to their lack of common sense but hey what can u do?

Realistically, if they lived in a more rural area, the distance between houses may be great enough to warrant a restraining order. No one said she lived in a suburban neighbourhood. Also, if this boyfriend wanted to be vindictive enough, he could have recorded her driving by, etc. to prove his case, among other things. Perhaps there are other factors to consider that may be considered 'stalking'.
I agree it's very far-fetched, but it is possible.

a restraining order is DIFFERENT than a order of protection or an ex parte. A restraining order is NOT related to a police department at all, you hire a lawyer to get one, and you can get one granted for almost anything. Orders of protection are much harder to get....

I definitely second #16. People need to get over themselves, trying to point out how ever FML is either fake or not worthy of an FML. If you don't like it, fine...I know there are quite a few that I read and I think "...Okay?" after doing so, but spamming up EVERY SINGLE ONE with at least one "This is sooooo fake" is obnoxious and counter-productive. There are different kinds of restraining orders. Getting one so that a person can't come within a certain distance of you is pretty difficult and you have to prove that you're in danger from the person. Getting one that says a person can't contact you is a bit easier to get, so perhaps that is what this FML refers to. In that case, though, living 2 houses away wouldn't really make a difference.

Don't you have to go to court if someone takes out a restraining order against you? The only way this is real is if the OP was informed today that their ex was taking out a restraining order on them for driving past his house. If this is true, yes, FYL.

#14, here's my guess of what happened. The ex filed for the restraining order, and then the police interviewed the OP. After talking to the police and getting things straightened out, the OP posted this FML. So the FML is that 1) the OP had to go down to the police station (or talk to the police) in the first place and convince them s/he isn't a stalker, 2) the OP now has an extremely awkward relationship with the ex, and 3) the OP has discovered that s/he was apparently at some point in time dating a paranoid moron.
I call BS on this.
Judges for the most part aren't stupid. I'm pretty sure that at some point in the court proceedings the fact would have come up that you live two houses down, the judge just doesn't say "who do you want this restraining order against again?" "Jane Doe." "OK, here's your restraining order!"
I also find it hard to believe you "found out" there's a restraining order, mainly because legal defendants have this tiny thing called "right to face the accuser."
I dont know why people are saying its fake... where im from, in Canada it takes less than 3 hours to get a permanent restraining order. who cares if its fake anyways. nobody cares. shut the hell up : )

pretty sure this is fake, my stepmom is a lawyer & just got a restraining order against someone and it's a fairly complicated process. you can't just tell the judge you want a restraining order against someone and get it.

Although some people are right that it takes a TON of paperwork to get a restraining order, I've heard of them being handed out in silly cases like these.

I know some guys become real assholes if their girlfriend breaks up, but getting a restraining order as a revenge shows this guy is smart. An idiot would have slashed her tires, thrown eggs at her window, threatened her, or something else... Anyway, he would had chosen a more direct revenge.
This is too subtle for a revenge, I think it's very likely the guy is too smart to become a dick just because he's upset about the break up. Seems to me like he really has a good reason to do this. Maybe the OP didn't do something to deserve a restraining order, but she probably did something bad to him.
Anyway, I'm not claiming I know the exact situation. My point is just this: don't bitch at the OP or her ex boyfriend. We don't know the full story. But if you're gonna bitch at any of them, bitching at the OP is obviously your best bet. You would have received a court summons if someone was trying to put a restraining order against you. So either this is a fake post or somebody told you a lie so you wouldn't go near him lol.
But it is possible to get a restraining order against someone who lives very close to you. I had one against someone who lived about 4 houses away from me.... but like I said, he was summoned to court and by law he has to be fully aware of the restraining order circumstances.

ya, me and my sister have a restraining order against my sisters ex boyfriend who was abusive, it took about a month to get the restraining order passed by a judge. (now he is in jail :) )And i think this has been said but if you guys live 2 houses apart there is no way that the judge will approve the order.

As the OP implied, he was probably angry at her driving by his house every day, even though she had to. The fact that she lived that close but that he was upset by it doesn't show intelligence or good reason. It's no safer to assume that the girlfriend did something than that the boyfriend did something. There are cases of crazies doing extreme things all of the time. Just because he went as far as to get a restraining order doesn't mean he should get the benefit of the doubt...
