Man or woman?

Today, I went for a run. I ended up being tackled by two cops, handcuffed, and dragged to the station with no explanation. Turns out a house nearby had been robbed and the best description they got was 'A man running'. I didn't even get an apology. FML

Fake, the police can't force you into the car without accusing you of a crime.

#4 - On 08/01/2009 at 6:15am by blalien

(+1)

Yeah they can, they're just not supposed to...

#27 - On 08/01/2009 at 8:01am by nebjamin69

(0)

There are certain isolated cases in which a person can be detained without being accused. This is not one of those situations.

If this actually happened, this would not be an FML. This would be a MLIG about the hundred thousand dollar wrongful arrest settlement.

#31 - On 08/01/2009 at 8:36am by blalien

(+1)

#8 and #47
The writ of habeus corpus gives them at least 24 hours to charge you with a crime, I think it might even be 72 hours actually. Your statement about detention without accusation is actually irrelevant, this was an arrest not a person being detained. As implied by the time limit on habeus corpus they absolutely can arrest you without charging you, it is just that they have to eventually let you go, which in this case they obviously did. The police can, and in fact do this kind of shit every single day. In fact when police pull over and detain people for looking suspicious they almost always make the claim that the person fits a description. In the OPs case being told this wouldn't even be a lie. Stupid people give the police vague descriptions all the time and they use it to harass, detain, arrest, and sometimes beat the shit out of whoever they want.

#51 - On 08/01/2009 at 10:59am by NoMercy1

(0)

not really because chances are if the OP tried to take them to court or anything, the cops would get much better lawyers than the OP. and besides, they could just lie about what they did and who is the judge going to back up, the fellow men of "law and order" or some random guy who was just arrested? lol

#7 - On 08/01/2009 at 6:22am by wrigglezeus

(0)

But they still have to tell you why they're arresting you.

#11 - On 08/01/2009 at 6:39am by blalien

(0)

Actually, they don't have to tell you until you are charged at the police station.

#20 - On 08/01/2009 at 7:43am by bented

(0)

Not even then, they usually would tell you then but they don't have to. It is possible albeit very unlikely you wouldn't hear the charges until you were being arraigned in court, which in California could be like 4-5 days later if you were unlucky enough to be jailed over the weekend when the courts aren't open.

I didn't think anyone ever really gets an apology.

This is why I only run on the school track though.

Popos busted into a local mayor's house, shot his two dogs and ransacked the place on a bogus drug suspicion... still no apology.

#10 - On 08/01/2009 at 6:33am by FPsLife

(+2)

You only run on the school track incase someone called the cops for a robbery, desribed the robber as a man running and the cops saw you running and took you into the station?

#47 - On 08/01/2009 at 10:42am by ivoteno

(0)

Have you never been running before? I've been harassed just because some woman didn't want me running by her house because I might someday decide to scratch her new car. It also can be quite dangerous to run on the side of the road. Doesn't matter what you're wearing or really where. The school track is safer, and if you're there, running, nobody really suspects you of anything. And at least here, the police do stop random runners sometimes. I prefer to avoid that.

sounds like a recent fml, I call fake

#12 - On 08/01/2009 at 6:59am by Pastor_Rich

(-1)

I call shenanigans.

We don't respond to 2-11 by stuffing a random runner in the car, and we sure as hell don't do it without an explanation.

They can reasonably stop and question you. If they deem necessary, yes, they can take you to the station. But unless they were already calling after you and you didn't stop, they're not going to "tackle" and drag you off.

Then again... you DO live in Massachusetts... ;-)

#13 - On 08/01/2009 at 7:00am by hanamama

(0)

yeah, I agree with shenanigans.... they'll stop and question, ask for ID, etc.

#45 - On 08/01/2009 at 10:36am by Hobbz_

As you eluded to. Not all police departments are equal. Some cops just love tackling. Even if this isn't true for the OP it's absurd to think it never happens.

#54 - On 08/01/2009 at 11:05am by NoMercy1

(+1)

Maybe the OP was listening to music while running, so he didn't hear the cops telling him to stop, at which point they tackled him?

#24 - On 08/01/2009 at 7:58am by percussionchic

Because in some jurisdictions (don't know exactly about the US) apologising is legally much like admitting fault and can get them in more trouble in case OP sues. At least, that's my guess :)

#51_____ im so sorry but you are trying to be smart, but in fact make yourself sound like an idiot. Habeas Corpus (literally: you (will) have the body), is a action seeking relief from an unlawful detention. You might have confused HC for Miranda Rights (see, miranda v. arizona... "you have the right to remain silent, anything you say can and will be used against you ...etc etc"). But regardless, IF this is real, there are multiple lawsuits that can and SHOULD be filed: including unlawful arrest, excessive force, and civil rights violations.

#57____ stop whining... you either are the most unlucky person ever, or are constantly in the wrong place at the wrong time (in which case, you might want to examine your choice of friends/where you spend time)... getting arrested once for something you didnt do, is regrettable and tragic, but mistakes do happen... getting arrested multiple times for things you "didn't" do, doesnt happen

this was my fiance matt's fml. he can't be bothered to make his own darn account right now (-.-' men) so henceforth is him speaking:

I'm a pasty white irish-american guy, so i don't think race was an issue with the cops. I don't remember how fast i was running, and I was wearing a Red Sox shirt and shorts. If they did yell 'hey stop' or something, I definitely didn't hear them. No, it's not fake. And yes, a lot of the cops in this city are idiots. The only thing they would say to me was my Miranda rights, and arguing seemed like a bad idea at the time. I know not all cops are dickholes, but these ones were. and as far as I know, they're still trying to find the person who robbed that house. And I forgot to put it in the FML, but all this went down mid-morning.

bull shit, they HAVE to read you your miranda rights and tell you why you are being arrested. the cops can lose their jobs over that if you take legal action.

I didn't get tackled, but got cuffed and detained once - for having long hair and being in the car with a Mexican in the rich side of town. After a k-9 unit came out and fruitlessly searched me and the vehicle, one of the cops actually cussed me out for wasting their time (because I didn't have drugs on me).
