Content almost refused by staff

Today, I got into a car accident. A car pulled out in front of me and then stopped in the middle of the road, I slammed on my brakes but still hit him. He proceeded to tell me it was my fault and that because I didn't swerve into the mailbox next to the road and total my car, he would sue me. FML

I don't see the issue. If the police showed up, it's a cut and dried case! He's at fault. if he sues, you can counter sue and cost him more money.

I guess the issue is more the level of asshole some people can reach. #2 is right there's no way anyone else with a brain will believe you're at fault.
