File a police report and dispute the charges with your credit card company. I'm pretty sure that counts as fraud, identity theft, and larceny given that he physically stole the card from your wallet. Also, it's probably time to explore the joys of being single.

No, all that will do is make him feel justified instead of ashamed. File charges and legally go for his reasons to live.
