Wouldn't have mattered. Insurance would say she was stopped to close and it was her fault. I've seen a car ram into the back of a stopped car at which point the stopped car got pushed into the car in front of them, the middle car got blamed for damage to the front car for "not stopping a safe distance from the car in front of them"

Has happened to me. There was no damage, however they didn't just drive off. That's messed up. Hopefully your state required insurance.
