Put a passcode lock on your phone and don't tell him what it is. Unfortunately that won't bring back the pictures that are gone, but it will stop your brother from deleting things without permission anymore. Also, her mom is stupid for believing that he didn't know what he did wrong, he was smart enough to delete them in the first place!
If it's an iPhone you can use photo stream where you log into your game center on a new device and if it's android you can go on your google plus and they will be there under photos
If they were that important to you you should have backed them up on a server or online.
I feel your pain. My freshman year of college, my Ethics class had to write a 30 page paper as our final. I'd already finished it a week prior when my little brother asked to borrow my laptop because our desktop had a virus that made it unusable. The next morning, I got my laptop back, and not only was my Ethics paper gone, but so was the 10 page report I had to do for my Statistics class, and the 20 page paper for my English class. According to him, he couldn't tell which papers were his and mine, so he deleted mine so that he wouldn't get confused. My mom also had the same reaction, and told me that my brother was too young to understand what he did, even though he was 17 at that point. From then on, I learned not to let anyone use my laptop, and I now email myself papers, and add them to my dropbox when I finish them.

put your phone on kids mode while you sleep, or give it ur brother from next time..
Android backs up to Google. iPhone backs up to, ah, backs ups to.....something. Did you have that turned on?
For something important like that thr photos always end up somewhere else so i don't lose them if my phone decides it doesn't want them anymore.

Yikes. Maybe see if there's any sort of recovery software for phones? Should back up ASAP (phones can corrupt and lose things) and lock your phone in future.
