Today, I got into an accident and my bike broke. My insurance expired 5 days ago and the accident wasn't even my fault. The lady was on the phone and on the wrong side of the road. She's threatening to sue me even though her car is in better condition. There are no witnesses and no cameras either. FML

I feel like this was a motorcycle because he said that his insurance expired 5 days ago. I feel bad for OP but it is his fault because he let his insurance expire. I know insurance companies call and send notices, so that was on him for letting it pass. Even though he isn't at fault, there is a limit for what he can sue (if he wants to). And most likely he will get a citation/offense for driving without an insurance once police arrives

If it there were witnesses and/or cameras, you would still be in some trouble since you drove without an insurance. As for the scene of the accident, were there no pictures taken? If police were not called to the scene, you should have taken pictures to prove that she was indeed driving on the road side of the road. You should have also taken pictures of both her car and your bike to prove the severity of the damages. I will not be surprised if she went home and damaged it even more so that she can slap you with an even larger lawsuit.

Lose-lose here. YDI for letting your insurance lapse, but FYL for the stupid woman. One of my biggest pet peeves is people driving while on their damn phones. Nothing is so important that you can't pull over or take the call/text later. And it's even more irritating when the person on the phone drives stupidly and pulls this kind of crap, then acts like it's not their fault for driving unsafely. Ugh!
