In this case, the OP is well within her rights to file a suit, at the very least filing an insurance claim. I hope she got pictures.

This is why tow companies generally carry a million dollars worth of insurance. Just exchange insurance information with them and file a claim. They will either refer you to a shop or you can choose to go to one you trust.

Tow truck companies have huge insurance policies to cover situations like this, so long as you report damage ASAP, to the office that truck is based out of and the central office if they won't help, they will usually fully cover repair costs to keep themselves in good standings (meaning if it's not a write off they will pay you out instead of using their own insurance because it is a lot cheaper than having their policy costs spike).

I'm getting really sick and tired of "tow truck drivers just out for money" I work as a security officer in Virginia. I work with tow drivers almost every day. The vast majority of the time your car is getting towed, minus the vehicle being inoperable, it's because -you- did something stupid like parked in a fire lane, a handicapped space, blocked a resident in on a residential complex, the list goes on and on. Once upon a time, when I was but a broke-ass kid trying and failing at the whole "college" thing prior to joining the military, my car broke down on the roadway. I managed to coast into the turn lane, but was unable to push it any further. A guy in a pickup truck stopped to see if I was okay, and then informed me that in Virginia I could have my vehicle towed by county or state police because it was still in the lane of travel. He told me that he knew this because -he- was a tow driver. You know what he did? He helped me push my car off onto the shoulder so it was no longer in the lane of travel. He could have called it in to his company, or turned around and grabbed his own truck, but instead he helped me out. So yeah. Tow truck drivers are NOT "just out for money". Some are, sure - but not nearly all of them.

I can tell you right now that not all us drivers are out for the money. who else is gonna do this job? no one. we risk our lives every day saving assholes like you on the side of the highway. shit happens I'm sure it was not intentional.
