At least in the UK, the legality probably depends upon who took the photo - we don't really have a statutory privacy law (at least as far as I am aware) but copyright in the photo will belong to you if you took the photo and sent it to him. There is clearly an implied license that he can use if for "personal" use (perhaps more personal here than usual) but I would have thought the nature of the material implies that it was not a license for distribution unless you explicitly say he can post it. If he takes the photo and you are aware of it then you have no copyright control over it. I can only imagine that a concealed camera picture is a common-law tort even without a statutory privacy law.
