He would have a perfectly valid and upstanding counter claim which would negate either claim. The way you're saying it is basically "if a guy sleeps with a drunk girl, he's a rapist. Eladar, I don't agree with the law, but you're wrong. Even if they're both equally drunk, he can still be charged with sexual assault, and no she cannot be charged with the same. And yes, her not being able to remember is also grounds for his prosecution, not that I think it's right! But yeah, I don't understand why everybody says he deserves it.
