That's a false statement if the police said that.
He might have had permission to take the Laptop out of the house but that doesn't mean he can just keep it. Since he doesn't want to give it back it is still theft.

You should continue reporting this to police or to another officer if possible.

small claims court, here you come. Other options include contacting his own mom, which social media is great for finding, or sending your husband and friend to his house (amazing how tough they aren't when another man is involved) and even contacting his boss. So sorry this happened to you.

Certified letter to him with signature proof he received it saying "Return my laptop to me within X amount of days untouched and unharmed or else I will report you for theft"... Then follow through.
