its not a small claims court case. You call the cops because the check was made out to the OP and the roommate stole the check AND cashed it. A felony I would imagine in most states.

Because things like a roommate stealing your paycheck should never have to have a slow and "nice" process. People breaking laws should get no consideration.

It would be one thing if the roomate took it for, oh I don't know, a kidney transplant for his cat...something emergency like...but he took it and GAMBLED it away. ANY scenario where he takes the check and cashes it is theft, but it is why he did it that may have saved him. If his kid needed diapers, maybe some leniency would be in order, and you could give him a chance to fix it. THIS though, this has to be dealt with right away.

You can usually choose whether to use direct deposit or get a check in the USA.
Exactly why most workplaces in the US are now requiring direct deposit (when the money goes directly into the account) to prevent something like this from happening.
US banking market is much more fragmented than UK. Checks (cheques) are much more common as well. It took some getting used to. My landlord in US wanted a monthly cheque, whereas in UK most people want a standing order

My thoughts exactly. Unless the OP endorsed it before going the bank (something hilariously stupid that would allow whoever got their hands on the check to cash it) they would have to commit forgery.
yeah...I think this may be a fake post just to get on the front page. You usually need the check endorsed, and a lot of banks actually require the original person's ID. even a copy of it.

How did your roommate take your money? If he was cashing your check, he would have had to present ID. Otherwise the money would have been deposited into your account, where he (presumably) couldn't get at it. Though I suppose it's possible that he could have also "borrowed" your ID, if the two of you look similar enough to fool a bank teller.
In any event, that's clearly theft. Report it to somebody immediately. I would suggest your RA/housing authority, since you're living in a dorm. They might be able to solve it, which will spare you the hassle of filing a police report, etc.

you dont need an ID to cash a check if the person endorses it over to you aka signing the back. he probably just forged his roommates signature and cashed it himself. ive done that with checks for close friends who dont have their ID with them, dont have a bank account, etc.
I've done that, too, but it required me showing MY ID to the bank teller so they'd know it was legit.
I don't need ID when I deposit my paychecks because I have a debit card that I have to swipe first so that the bank teller can pull up my account (I use TD Bank). If someone knew my PIN and stole my card they could cash it, so I never leave my card or checks lying around anywhere. I also never ever sign the endorsement line on the back until I actually get to the bank.

I bank with Citibank and realized this after I deposited a check from my pets health insurance, the funds were available to me that moment!!

So did he forge your signature? Or were you stupid enough to sign it before you got to the bank to do whatever you were going to do with it? Either way, he's in trouble.
And for those of you saying you need an ID, that's BS. I have never once had to present ID at National City to either deposit or get cash back. So if that was the case with OP, all the roommate needed was the check to have already been signed and he was good to go.
I use Nationalcity and i ALWAYS need my ID to take money out. I would be a little concerned if your bank isn't asking for your ID. Unless they know you on a first-name-basis.... then duh.

Taking the precaution to protect your money is a simple common sense, whether you see a theft coming or not. You can't prevent your roommate from stealing your money, but you can make it difficult to do to begin with. I lived and worked in a dorm, and it's a known fact that most dorm thefts can be prevented by simple precautionary measures. No, I don't assume everyone in my life has ill intents but yes, it's my responsibility to take the initiative to protect my own stuff, so hold off calling me an idiot until you can come up with a proper analogy.
In any case, OP is more likely than not to get his money back. Take it as a lesson and don't let it happen again.

I find this false and hard to believe. Unless you had signed the back of the cheque or cashed it in, no one else has the right to use that cheque. So even if he gambled it away, the guy who won won't be able to use it anyways.
Your roommate is guilty of fraud if he cashed the check. You can have him expelled for that, as well as arrested. I would suggest doing both.

There is such a thing as signing over a check. If OP signed the back he would have just had to sign his name (in which case YDI). The roomate could have forged his signature as well. Eithe way you do need to file a police report, I would not trust your roomate to pay you back.
That is theft, and assuming your roomie cashed the check, it's fraud as well. It's possibly identity theft, too. Your roommate could end up in jail for a long time. Tell him if he doesn't give your money back that you'll call the cops. And don't delete that text just in case.
In the future, keep your money where it's safe or do a direct deposit.

oh dont worry OP if he went to an atm and deposited the check he gonna all the suddent notice the amount of the check missing from his account when the bank processes the cheque's and the bank will probaly call you to check if you let him deposit the cheque in his account and then you just tell them no and that he stole it simple as that
FAKE. He wouldn't be able to cash your check, because he would need to show ID, and obviously, he isn't you. The only way to cash it would be for him to put it into YOUR bank account, which he wouldn't be able to withdraw from.
to everyone saying you can cash a check without an id, where the fuck do you live? every place ive been to to cash my paychecks or deposit them at the bank checks my id. and this is in several towns in new york and a few places around los angeles. to the OP: lock that text, tell him he owes you your paycheck plus some interest. if he refuses/doesnt within a day or two then go to the cops and get him charged with theft. and to make things less awkward for the rest of the school year, talk to your RA and see if you can get your room/roomie switched.

This FML is complete bullshit. Anywhere in the United States you need an ID to cash any check, anywhere. So even if he did manage to cash the check, the OP would have no problem getting his money back.
This. Unless your roommate also looks like you and stole your driver's licence, there's no way they would have let him cash the check.
In Canada, the only way someone else can cash a check written out to you is if you sign the endorsement line on the back. In that case, if you left an endorsed check lying around it's your own fucking fault.
Nobody actually asks for ID though, at least, not around here.
More and more FMLs about people taking others money. I really can't imagine someone so immature to think that they will do whatever they want and get away with it. But these FML are continuously proving me wrong.

Tell him to give you double the amount the check was for within a month or you're sending his ass to jail for check fraud.
First off, you shouldn't have just left that laying around. There are plenty of places you could have put that where it was more safe (hell, even a pants pocket would do). Second, what your roomie did is called identity fraud, not to mention check fraud. Don't bother trying to extract your money from him (it's highly improbably that you will anyway); just report him to the authorities.

Either this is fake, or you're a complete idiot. You cannot cash a check without signing it. Unless your roommate signed it fraudulently (in which case you are entitled to take him to court), you probably just signed it and left it lying around, which is stupid and is completely your fault.
